Terms and Conditions

Last updated: 3 October 2026

1. Who we are and when these terms apply

1.1 These terms apply to all contracts for goods concluded through weserhalle.com and to all sales of artworks arranged by enquiry between Ben Hammond, trading as Weserhalle, Weserstraße 56, 12045 Berlin, Germany, email info@weserhalle.com (“we”, “us”) and our customers (“you”).

1.2 A consumer is any natural person who concludes a contract for purposes that lie predominantly outside their trade, business or profession. A business customer is any natural or legal person or partnership acting in the exercise of their trade, business or profession.

1.3 Terms of a customer that differ from these terms do not apply unless we have expressly agreed to them in writing.

2. What we sell

2.1 Editions and shop items (editions, prints, calendars and other items in the shop) can be bought directly on the website.

2.2 Original artworks are not sold through the online shop. They are sold by enquiry, as described in section 4.

2.3 We photograph and describe every work as accurately as we can. Colours can look different from screen to screen. Prints and hand-finished works can show slight variations that are inherent to the medium and the process.

3. Buying in the shop

3.1 The items in our shop are not a binding offer, but an invitation to you to place an order.

3.2 You can add items to the basket and review and correct all entries at any time before you order. Before you place your order, the checkout shows a summary of the items, prices, shipping costs and your details.

3.3 By clicking “Buy now”, you make a binding offer to buy the items in your basket. If you pay with Apple Pay, Google Pay or Link, you make your binding offer when you confirm the payment in the payment window.

3.4 Payment is taken when you order. The contract is concluded when your payment is confirmed; we then send you an order confirmation by email.

3.5 The contract language is English. We store the contract text. You receive your order details and these terms with your order confirmation. If you have an account, you can also view your orders there.

4. Original artworks: enquiries

4.1 Enquiries about works — through the website, by email, by phone or in the gallery — are not binding for either side.

4.2 If a work is available, we send you a written offer by email that states the work, the price including VAT, the delivery or collection terms and the payment terms. The contract is concluded when you accept our offer in text form, for example by replying by email.

4.3 We can reserve a work for you for an agreed period. A reservation does not oblige either side to conclude a contract unless we have agreed otherwise.

4.4 If you are a consumer and the contract is concluded entirely by distance communication (email, phone, website), you have a statutory right of withdrawal as set out in our Cancellation Policy. If you buy a work in person at the gallery, there is no statutory right of withdrawal.

4.5 Unless the offer says otherwise, the invoice is payable by bank transfer within 14 days.

4.6 Packing, crating, shipping and insurance of original works are quoted individually in the offer. You can also collect the work from the gallery by appointment.

5. Prices and payment

5.1 All prices are in euros and include statutory VAT. Shipping costs are shown before you order.

5.2 In the shop you can pay by card, Apple Pay, Google Pay or Link. Payments are processed by Stripe.

5.3 For deliveries outside the European Union, import duties and taxes may apply. Where the checkout states that duties are included, we pay them. Otherwise they are payable by you to the authorities or the carrier.

6. Delivery and collection

6.1 We deliver to the countries offered at checkout. The delivery time is shown on the product page. For editions that are printed to order, the dispatch date stated on the product page applies.

6.2 If collection is offered at checkout, you can collect your order from the gallery during opening hours or by appointment. We let you know by email when it is ready.

6.3 Please check your parcel on delivery and tell the carrier and us as soon as possible about any visible transport damage. This helps us make a claim against the carrier. It does not affect your statutory rights.

6.4 If you are a business customer, the risk passes to you when the goods are handed to the carrier.

7. Right of withdrawal

If you are a consumer, you have a right of withdrawal. Our Cancellation Policy explains it, including how to withdraw online with the withdrawal function on our website.

8. Retention of title

Goods remain our property until they have been paid for in full.

9. Warranty

The statutory warranty rights apply. If you are a business customer, the warranty period for new goods is one year from delivery; this does not apply to claims under section 10.

10. Liability

10.1 We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and where we have given a guarantee.

10.2 For slight negligence, we are liable only if we breach an obligation that is essential to the proper performance of the contract and on which you can regularly rely. In that case our liability is limited to the damage that is foreseeable and typical for the contract.

10.3 These limitations also apply to our representatives and vicarious agents.

11. Copyright

11.1 When you buy an artwork or edition, you acquire ownership of the object, not the copyright. All rights in the work remain with the artist.

11.2 You may display, lend and resell the work. Any reproduction or commercial use — for example printing, merchandise or advertising — needs the artist’s permission. You are welcome to share photographs of the work for non-commercial purposes, crediting the artist.

12. Collector accounts and newsletter

12.1 Collector accounts are free. Prices shown to signed-in collectors are information, not an offer. Original works are sold as set out in section 4.

12.2 You can close your account at any time by emailing info@weserhalle.com. We may close an account that is misused.

12.3 We only send our newsletter with your consent. You can unsubscribe at any time with the link in every email. Details are in our Privacy Policy.

13. Consumer dispute resolution

We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.

14. Final provisions

14.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of the country where you have your habitual residence.

14.2 If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from contracts with us is Berlin.
